OGC guidance note on 10-day mandatory standstill period for public sector contracts now available

The Office of Government Commerce held a six-week public consultation in October 2005 to gather views on the implementation of a 10-day mandatory standstill period for public contracts, following European Court of Justice (ECJ) judgements in two cases, both against Austria.

To comply with the ECJ judgments, and after detailed negotiations with the European Commission, the mandatory 10-day standstill requirement has been incorporated into the new procurement regulations (implementing the revised EU procurement directives), which came into force on January 31, 2006.

The next opportunity to consider the approach to these judgements, across the EU, will be in the negotiations to adopt the new EU remedies directives, which are expected to begin in April 2006.

The UK is party to these negotiations and OGC welcomes input from interested parties on any areas of difficulty which are identified in operating the standstill requirement.
