In 2005, an evaluation of forms of contract for the procurement of construction concluded that the NEC3 suite of contracts was fully compliant with OGC's Achieving Excellence in Construction initiative and OGC gave its support to the use of NEC3 by public sector procurers.
Earlier forms of government contract, such as GC Works, had clauses within them that specifically catered for some of the more common issues faced by government such as physical and personnel security. The NEC3 forms make provision for such requirements to be inserted as additional clauses at "Option Z" (often referred to as Z clauses). In order to assist procurers considering the use of such clauses, OGC and NEC3 are making available a standard form of words for such additional clauses, which may be of use to UK government clients when using the NEC3 contracts. These Z clauses are only intended for use with the NEC3 standard forms of contract.
By producing the clauses in collaboration, the NEC and OGC have ensured compatibility with the NEC3 suite of contracts and public sector terminology. Whilst optional, UK government client construction procurers should consider using the Z clauses in conjunction with the main contract.
