PPN Action Note on the Use of Intermediaries

OGC has published a PPN Action Note on the use of intermediaries in the publication of OJEU notices on Tenders Electronic Daily.

This is in response to a letter from the European Commission, who raised objections to the practice of including links to intermediaries' websites in OJEU contract notices published on TED.

The Commission's concern relates to cases where such links do not take the user directly to additional information that specifically relates to the contract opportunity in the contract notice. Instead, such links are used as a means of advertising the intermediary's services and/or soliciting registration with the intermediary. Contracting authorities are asked to ensure that, when they use such intermediaries, any links contained in the OJEU are formulated appropriately, or removed altogether.
