Below are two useful sources of help if you are a UK supplier having difficulty competing for contracts abroad, or a supplier in another Member State having difficulty competing for contracts in the UK.
The Public Procurement Network (PPN) is a network of central government procurement policy officials in 30 European countries. The PPN is specifically aimed at helping a supplier who is facing problems with a procurement procedure abroad. This is a fast and informal system to clarify misunderstandings and suspicions of infringements to the public procurement rules in the early stages of procurement procedures. Members have agreed common rules on how to informally pursue suspicions of irregularities before contracts are signed, thereby saving legal fees. This informal system has been successfully tested for three years and it enjoys the full support of the European Commission. SOLVIT is an on-line problem-solving network in which EU Member States work together to solve, without legal proceedings, problems caused by the misapplication of Internal Market law by public authorities. There is a SOLVIT centre in every European Union Member State. SOLVIT Centres can help with handling complaints from both citizens and businesses. As SOLVIT is an Alternative Dispute Resolution Mechanism, there are certain instances where the system will not be used. These include where legal proceedings are already underway; where deadlines under national law need to be respected to maintain rights and where the problem is a business-to-business or business to consumer one.
